The couple may wish to have the co-parent legally adopt the child. In many states, second parent adoptions are allowed. However, N.C.G.S. § 48-2-301, provides, 

"If the individual who files the [adoption] petition is unmarried, no other individual may join in the petition." 

This new statute effectively prohibits second parent adoptions by unmarried couples in North Carolina.
