If the relationship dissolves, the co-parent has no legal rights or responsibilities with respect to the child. If the partners had entered into a parenting agreement, the agreement should provide for custody, visitation and support upon the break-up of the partners. Any power of attorney that exists easily can be revoked. In some states, courts have awarded visitation to a co-parent and even ordered the co-parent to pay child support. There are no cases in North Carolina and it is unlikely that courts will be sympathetic.
